A provision of the Health Care bill inserted by former Senator Robert Byrd (D-WV) signed into law in 2010 has made the burden of proof for black lung claims less stringent. Under the new provision, miners who have worked in underground mines for 15 years who also suffer from severe respiratory problems are now presumed to have black lung disease. This provision shifts the onus from employee to employer and will likely lead to a large increase in the number of black lung claims for US mining firms in the near future.
An expert panel discusses the genesis of this regulatory reform, potential implications for the mining industry and the insurance industry, and provide examples of recent claims to illustrate how this legislation has changed the landscape for black lung claimants and their employers.
